COURT FILINGS - GENERAL | CUYAHOGA COUNTY CLERK OF COURTS

Accepts filings of initial actions, pleading in pending, and post decree actions in all civil, divorce, and 8th District Court of Appeals cases and filing fees and posting of bonds in civil and divorce actions. Actions filed here include, but may not be limited to, civil actions, divorce complaints, annulment complaints, dissolution petitions, legal separations, foreclosure complaints, quiet title, partition, appeals, motion to vacate, and post decree motions. Provides forms that enable eligible individuals to file a poverty affidavit that may reduce or eliminate fees in civil cases. Poverty affidavits only apply to one case at a time. Criminal filings come to this office mainly through the Prosecutor's Office; individuals generally contact the Police Dept. when wanting to file criminal charges. Makes available an electronic docket providing some information about civil and divorce proceedings including a schedule of hearings.

Application process

Before filing, it is strongly recommended to contact an attorney or an agency that can offer assistance with the particular action to be filed. To file an action, walk in and go to the Filing Desk. If requesting a Poverty Affidavit, may ask for a form that will have to be notarized and returned here with accompanying documents. For information phone or walk in. Fee

Fixed fee for filing fees. Those who are low-income may be eligible to file a poverty affidavit, which may eliminate or reduce fees for a civil case.

Eligibility

Adults 18 and older. Youth under 18 must have a parent or guardian file. Other eligibility may apply, such as Cuyahoga County residency, depending on what is being filed.
