Casey'S Law | Cuyahoga County Common Pleas Court - Probate Division

Provides involuntary psychiatric evaluations and possible commitment of persons who are mentally ill and pose a danger to themselves and/or others. This is referred to as having someone "probated" and should be used as a last resort. Other avenues for assistance such as the police or a mental health agency should be utilized first. An Order of Detention is filed and given to the police department. Once it is received by the police department, it must be carried through. The police will then pick up the probated individual and take them to the hospital and within 24 hours a psychiatric evaluation will be done. A court date for a hearing will be set and will be held within five court days, or ten calendar days after the person is taken to the hospital. At the hearing, the person will be assigned a court appointed attorney (if needed) and it will be decided if the person should be committed or let go.
